BYE-LAWS OF Title Registration Committee

PREAMBLE
  1. No individual is bigger and more important than an organization. Keeping in view the principles of equality among the film Producers, a landmark historical decision was taken by our predecessors in the year 1991 to make a Supreme Body of Film Producers representing Indian Motion Picture Producers’ Association (IMPPA) and Western India Film Producers Association (WIFPA) for tackling their problems, giving solutions to their grievances, to approve titles and keep a vigil on the misuse of the titles of their films, approve the publicity of their films for censor having in mind the morals, ethics, cultural values of the big society of which we are a small part.

    With the mushrooming of TV Channels and growth of TV Serials, Animation Films, Documentary Films, Short Films, Music Albums, Event Shows, Reality Shows, Web Films/ Series and last but not the least Digital Platforms gave birth to an unending saga of entertainment round the clock.

    It was the necessity of the changing times that certain amendments were suggested by the visionary Hon. Executive Committee of FMC to equip themselves to face new problems and violations for the dignity and honour of Producers. BYE-LAWS, an instrument of faith and allegiance to the Supreme Body, prepared on 28th Jan. 1992 were amended till 26th Sept. 2020 by the progressive, energetic and positive Executive Committee of Film Makers Combine, to be effective from 27st Sept. 2020.

    It was with the objective of keeping all Producers bonded together under one umbrella Film Makers Combine; certain rules, regulations and byelaws were drafted for the smooth functioning of the Film & TV Industry.

  2. NAME & ADDRESS
    Film Makers Combine has its registered office situated at Greater Mumbai at IMPPA, G-1 to 7, Crescent Towers, Opp. Morya House, Off New Link Road, Andheri (W), Mumbai – 400 053.

  3. AIMS & OBJECTS
    a.   To organize and unite the film, television, digital platforms and allied Producers to inculcate self-discipline, goodwill, professionalism and regulate their relations with each others involved in the film & television productions.
    b.  To resolve the professional difficulties, problems and settle grievances of the member Producers involved in the production of films and television programs for smooth functioning.
    c.  To cooperate and coordinate with organizations having similar objects and functions in the Entertainment Industry in the Entire World including India.
    d.  To lay down a Code of Conduct for its members.
    e.  To take up all activities from time to time what might be necessary for the Supreme Body.
    f.  To obtain representation in connection with the Indian film & Television Industry organizations.
    g.  To grant titles to the Producers for their Feature Films/ TV Serials/ Tele – Films/ Video Films/ Web Films/ Series, Animation Films/ T.V. News/ Documentary Films/ Short Films/ Music Albums/ Events Shows/ Reality Shows / Digital Platforms and/ or any other audio/ visual formats or invented in future as per the rules and regulations appended in the Bye-Laws.
    h.  To hear and decide the complaints and grievances of member Producers of IMPPA/ WIFPA about the misuse of titles, rejection of titles and non clearance of publicity.
    i.  To approve the publicity designs of the films keeping in view the guidelines of Govt. of India from time to time for certification of films.
    j.  To adopt zero tolerance for titles and Publicity Clearance of films that degrade our nation and hurt the respect and it’s sanctity.

  5. HON. CHAIRMAN a) Hon. Chairman shall preside over all the meetings, sign all minutes, shall have a casting vote in case of a tie and shall have power, if necessary, to call Special or Emergency meetings of the General Body or the Executive Committee. In the absence of both Hon. Chairmen, the members present shall elect a Chairman amongst themselves and conduct that particular meeting.
    b) There will be two Hon. Chairmen of Film Makers Combine one each representative of Indian Motion Picture Producers’ Association (IMPPA) & Western India Film Producers Association (WIFPA) and will head ex officio all the committee meetings of Film Makers Combine.

  6. HON. GENERAL SECRETARY a) Hon. General Secretary, on whom the powers and duties for the smooth running of Film Makers Combine are delegated, shall check and record the minutes of all meetings, conduct all correspondence, convene Executive Committee and all Sub Committees meetings and exercise supervision over the day to day affairs of the Film Makers Combine. He/ she shall be empowered to engage paid assistants for organizing and clerical purposes that he/ she may deem necessary but not without the prior sanction of the Executive Committee.
    b) There will be two Hon. General Secretaries, one each representative of Indian Motion Picture Producers’ Association (IMPPA) & Western India Film Producers Association (WIFPA) who will be ex officio members of all Committees of Film Makers Combine.

  7. HON. TREASURER a) Hon. Treasurer shall supervise the Accountant appointed by Film Makers Combine for all the sums of monies, which may from time to time be paid into the association’s funds, and for duly banking them. The Accountant shall make payments for all the expenditure sanctioned by the Executive Committee and shall maintain all books of accounts. The Accountant shall get prepared and submit to the Executive Committee every month an account of income and expenditure and shall get prepared audited balance sheet annually showing clearly items of receipts and expenditure.
    b) There will be two Hon. Treasurers, one each representative of Indian Motion Picture Producers’ Association (IMPPA) & Western India Film Producers Association (WIFPA) who will be ex officio members of all Committees of Film Makers Combine.

  8. PUBLICITY SCREENING COMMITTEE
    Film Makers Combine has been duly authorized by Information & Broadcasting Ministry, New Delhi to approve the Publicity of the member producers of its affiliates Indian Motion Picture Producers’ Association (IMPPA) & Western India Film Producers Association (WIFPA) before the application of censor is submitted by the Producers to Central Board of Film Certification.

  9. a) The Publicity Screening Committee of Film Makers Combine has been formed to coordinate the aesthetic designs of the publicity material of the film of the Producer with the changing guidelines of the Censor Board of Film Certification and prevailing trends of morals, ethics and cultural legacy of the society. Before presenting the publicity to Central Board of Film Certification, self-censorship by the Producer is judged and the publicity is approved.
    b) Publicity Screening Committee of Film Makers Combine would give clearance to Publicity designs of the film for censor, only after receiving a letter from the Affiliate signed by the Secretary that the Publicity Designs matched as per the undertaking given at the time of registration of titles.
    c) i) Any 2 (two) members authorized by Publicity Screening Committee of Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) will be authorized to sign the Publicity Clearance designs of their own respective Affiliate members to be furnished to Central Board of Film Certification.
    ii)In case any one of the two authorized Publicity Clearance Member of Indian Motion Picture Producers’ Association (IMPPA) is not available to sign the Publicity Clearance of his/ her member, any one authorized member of Western India Film Producers Association (WIFPA) Publicity Screening Committee would sign provided the authorized member of Indian Motion Picture Producers’ Association (IMPPA) Publicity Screening Committee puts his/ her signature first.
    iii) It will be the same procedure if any of the two authorized Publicity Screening Committee member of Western India Film Producers Association (WIFPA) is not available to sign the Publicity Clearance of their own member, any one authorized member of Western India Film Producers Association (WIFPA) would sign first followed by Indian Motion Picture Producers’ Association (IMPPA) Publicity Screening Committee member
    d)It is mandatory for a Producer to register the title/s with Film Makers Combine prior to registration of title/s with Trade Mark authorities because the title granted by Title Registration Committee is necessary for clearance of Publicity by Publicity Screening Committee for censor of the film.
    e) Minimum 5 (five) members each from Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) nominated by Film Makers Combine will form the Publicity Screening Committee.

  10. GRIEVANCES COMMITTEE
    a) The Grievances Committee will hear the complaints and grievances of member Producers for re-consideration of the rejected titles and clearance of publicity in case of rejection by Title Registration Committee / Publicity Screening Committee.
    b) i) The Complainants are requested to file written complaints to their respective Associations.
    ii) The Affiliate Associations will forward the complaints of their members to Film Makers Combine for appropriate action.
    c) The Complainants are advised in their own interest that in case of any grievances, they should appeal to the Grievances Committee for redressal of their problems.
    d) Minimum 5 (five) members each from Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) nominated by Film Makers Combine will form the Grievances Committee.

  11. DISCIPLINARY COMMITTEE
    a)If the Producer is found violating the rules and regulation of Film Makers Combine and does not adhere to the guidelines, strict action will be taken against the Producer by the Film Makers Combine’s Disciplinary Committee.
    b) The Disciplinary Committee will take action against the erring Producers, after sending 3 (Three) notices to amend the wrong course taken by them.
    c) Disciplinary Committee has the inherent powers to cancel the title/s given to the Producer, block all his/ her allotted title/s, cancel the publicity for censor and recommend to the Affiliate to terminate the membership of the Producer based on the quantum of offence by the Producer, besides writing to Central Board of Film Certification not to censor the film of such Producer.
    d) In case of disciplinary action against the erring Producers, Film Makers Combine would be authorized to take any action against the Producers directly with the involvement of the Affiliate.
    e) i) If any Producer is found misusing the title/s and guilty of buying/ selling of titles, the Title Registration Committee will forward the complaint to the Disciplinary Committee for appropriate action.
    ii) The Disciplinary Committee will be empowered to cancel his/her titles, confiscation of their approved titles.
    iii) Impose penalty upto Rs. 50,000/- (Rupees Fifty Thousand Only) and/ or the discretion of Disciplinary Committee as it may deem fit.
    iv) And/ or termination of their membership from the Association.
    v) Further, the defaulters’ names would be sent to other associations with a request not to enroll them as members and not entertain them for the better prospects of the Film & TV Producers.
    f) Infringement by any Producer of these rules shall render him liable to disciplinary action and penalty as may be decided by Disciplinary Committee.
    g) An appeal shall lie with the Grievances Committee against the decision of the Title Registration Committee within 15 days for redressal of the problem.
    h) Minimum 5 (five) members each from Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) nominated by Film Makers Combine will form the Disciplinary Committee.

  12. ACCOUNTS COMMITTEE
    The Accounts Committee has been formed to review and find any irregularity in the financial accounts of Film Makers Combine for the Accounting year starting from April to March every year. The findings of the Accounts Committee will be forwarded to Executive Committee of Film Makers Combine. The Accountant and the Auditors are responsible for the rectifications of any fault and propriety of the Accounts.
    Each Hon. Chairman, Hon. Secretary and Hon. Treasurer of Indian Motion Picture Producers Association (IMPPA) and Western India Film Producers Association (WIFPA) elected to Film Makers Combine from IMPPA & WIFPA will be the Hon. Members of Accounts Committee. Hon. Chairmen can increase the number of member in Accounts Committee as per the requirement.

  13. RULES AND REGULATIONS COMMITTEE
    a)The Rules and Regulations Committee has been formed by Film Makers Combine to make rules, regulations and make amendments with the passage of time for the convenience of member Producers and smooth working of the Association
    b) Member Producers are advised to send their suggestions to their Affiliates, which will be directed to Film Makers Combine, who will take due cognizance of the suggested views.
    c) Minimum 5 (five) members each from Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) nominated by Film Makers Combine will form the Rules and Regulations Committee.

  14. GOVERNING COUNCIL Governing Council is the prime Committee of Film Makers Combine to check and regulate the working of all other Sub Committees. The decision of the Governing Council will be binding on all Hon. Members of all Sub Committees.
    Each Hon. Chairman, Hon. Secretary and Hon. Treasurer of Indian Motion Picture Producers Association (IMPPA) and Western India Film Producers Association (WIFPA) elected to Film Makers Combine from IMPPA & WIFPA will be the Hon. Members of Governing Council.
    It will be the ex officio powers of Hon. Chairman, Indian Motion Picture Producers Association (IMPPA) and Hon. Chairman, Western India Film Producers Association (WIFPA) to induct new members in the Governing Council from IMPPA/ WIFPA respectively. In case there is addition of another Producers’ Association in Film Makers Combine, their Hon. Chairman, Hon. Secretary and Hon. Treasurer would also become members of Governing Council.

  15. CODE OF CONDUCT Film Makers Combine has been comprised of Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) and duly authorized to approve/ reject/ keep pending titles of films/ tv shows/ web series and other formats to the applicant member Producers apart from providing Grievances Solutions and Publicity Clearance of films at the time of Censor. Before submitting your application for grant of title/s, you assure that you have read the rules and regulations of Title Registration Committee and make a solemn pledge that Memorandum and Articles of Film Makers Combine are binding on you and in case of any problem, you will directly address to Film Makers Combine and will never defy the guidelines of Film Makers Combine amended from time to time.
    Each member of Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) shall follow the Code of Conduct as under:
    a) A member shall do everything in his/ her power to uphold the honour and prestige of Film Makers Combine and the Affiliates i.e. Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) to which he/ she has the honour to belong to.
    b) A member shall always be respectful to the Hon. Chairmen and other Hon. Office Bearers of Film Makers Combine and also to his/ her fellow Producers.
    c) That as a member of the Affiliate, the Producer shall always conduct with dignity and decorum and shall at no time indulge in undesirable, unbecoming, undignified, disorderly or unruly conduct.
    d) That the Producer shall always owe his/ her allegiance and loyalty to the Affiliate and Film Makers Combine.
    e) That the Producer shall at no time either by word of mouth or by any action, cause or allow to be caused any disruption or disintegration in the Affiliate and would do nothing that would impair or jeopardize or harm the UNITY and SOLIDARITY of the Affiliate and Film Makers Combine.
    f) That the Producer at no time shall flout or defy the Film Makers Combine ’s directive irrespective of his/ her opinion about the directive.
    g) The Producer shall never do anything that would bring the Film Makers Combine in disrepute or lower its reputation.
    h) That in the event of any violation of this Code of Conduct or any laxity on the Producer’s part, he/ she shall submit himself/ herself to the disciplinary action that the Film Makers Combine may take against him/ her.

  16. Title Registration Committee
    Whereas it is considered necessary to provide Registration of Titles of Feature Films/ TV Serials/ Tele – Films/ Video Films/ Web Films/ Series, Animation Films/ T.V. News/ Documentary Films/ Short Films/ Music Albums/ Events Shows/ Reality Shows/ Digital Platforms and/ or any other audio/ visual formats or invented in future, with the Film Makers Combine, the Title Registration Committee of the Film Makers Combine is pleased to make the following Rules for registration of titles:
    These Rules shall be called the “Title Registration Rules” constituted by the Rules and Regulations Committee and shall come into force from 1st October 2019 and members are advised to ensure that the same are strictly implemented.

    TITLE
    A Title to qualify for registration must consist of distinctive words or letters in English and language of the film, whether with or without punctuation or other marks for feature films, Telefilms, TV Serials, Documentary/ Short films, Music albums, Digital Platforms, Event & Shows produced by bonafide members.

  17. TITLE REGISTRATION COMMITTEE
    means a Committee consisting of minimum 5 members appointed by each of the Affiliates i.e. Indian Motion Picture Producers’ Association (IMPPA) / Western India Film Producers Association (WIFPA) of Film Makers Combine.

  18. Title Registration Record
    means the complete record of titles with date of approval or rejection with name of Producer/ Banner in whose favour the decision has been taken by Title Registration Committee of Film Makers Combine.

  19. APPLICATION FOR TITLE REGISTRATION
    Any member of the Affiliate will apply in writing in the prescribed format addressed to the Secretary of the Affiliate of which he/she is member, duly signed by him/her or on his/her behalf by duly authorized person along with prescribed fees, to register any such title with the Film Makers Combine which is not already registered by any other Producer for producing Feature Films/ TV Serials/ Tele – Films/ Video Films/ Web Films/ Series, Animation Films/ T.V. News/ Documentary Films/ Short Films/ Music Albums/ Events Shows/ Reality Shows/ Digital Platforms and/ or any other audio/ visual formats or invented in future.

  20. GUIDELINES OF TITLE REGISTRATION COMMITTEE
    a)Registration/Re-registration of Title/s is/are subject to the approval of Title Registration Committee.
    b) i) The Title Registration Committee shall consider the application for registration of title and if the title is found by the Title Registration Committee to be eligible for registration, Title Registration Committee shall register the title and inform the Affiliate in writing about such registration and if the title is found not eligible for registration, the respective association shall inform the applicant
    ii) The reasons of rejection of the title for registration will be intimated to the Producer.
    c)Film Makers Combine will circulate weekly list of applied titles to other Associations inviting objections within 21 days from the dispatch date of weekly list.
    d) The Title Registration Committee may in its sole discretion register or refuse to register a title in a particular language, which has already been registered with the Film Makers Combine and/or other Associations.
    e) It is the sole discretion of the Title Registration Committee to register titles of Hindi language or similar titles in other regional languages.
    f) It is the sole discretion of the Title Registration Committee to register titles suffixing and/or prefixing words to an existing Title and allot the same provided the member should use uniform lettering.
    g) No Producer will be allowed to register more than 10 titles (excluding already released films/ already telecast TV serials) in favour of one single banner subject to the discretion of Title Registration Committee.
    h) No Producer will announce/ advertise/ publicize/ utilize any title, which is not registered with the Film Makers Combine. If any Producer is found violating these guidelines, he/she shall be liable to strict disciplinary action.
    i) All titles are registered with the clear understanding that the applicant will be using uniform lettering for the full title and under no circumstances; the Producer will use small lettering for some portion of the title and big lettering for other portion. Lettering shall be uniform for all words of the title.
    j) i) The title/s is/are registered for the exclusive use of the applicant Producer only and no Producer has any right whatsoever either to transfer or allow anyone else to use the said title/s.
    ii) In case, the Producer does not want to utilize the title/s registered in his/ her favour, he/ she is bound to surrender the registered title to the Association where he/ she is member Producer and the Committee shall be free to register the said title/s in favour of next eligible applicant Producer.
    iii) In case, there are more than one applicant for such surrendered title, the Committee would register the title in favour of the applicant who is first on the waiting list for registration of the said title.
    k) i) If the title applied by the Producer is rejected, he/ she will have to give in writing whether refund of money is required or adjustment with other title.
    ii) In case, the Producer wants to keep the applied title in waiting, he/ she shall confirm in writing
    iii) If there is no written instruction from the Producer, the deposited money will be returned to the Producer.
    l) If the registered title is found to be objectionable viz. vulgar/ in bad taste/ in abusive language/ offensive/ derogatory to the women/ our country, insulting to any community/ caste/ minority, the Title Registration Committee is empowered to cancel the allotment of title.
    m) The controversial titles would not be granted to Producers, which are rejected at the hands of censor, Film Makers Combine would get the guidelines of Central Board of Film Certifications to avoid the cancellation of titles, when the project is complete and find amicable solution with CBFC to clear those titles.
    n) i) If a member wishes to use title already registered with Film Makers Combine in the name of other banner, he/ she is at liberty to use the same, provided the title is surrendered to Film Makers Combine by the member in whose favour the title is registered.
    ii) It is subject to approval by Title Registration Committee
    iii) The applicant member’s involvement should be with the new project in capacity of important post in the banner.
    o) i) If a title applied by a member is on a name of a particular Person/ famous personality, i.e Celebrity Actor, Writer, Producer, Poet, Politician, Sportsman etc, No Objection Certificate of the concerned person for using his/her name as title has to be submitted by the member at the time of the submission of application.
    ii) In case the celebrity person is not alive, the Producer will have to produce the No Objection Certificate of his/ her legal heirs.
    iii) If the Producer wants to use the title based on a published material, he/ she will have to get written permission from the author and/ or the publisher, in case they are not alive, the permission from the legal heirs is mandatory.
    p)It is mandatory for a Producer to register/ renew the title/s with Film Makers Combine prior to registration of title/s with Trade Mark authorities because the title granted by Title Registration Committee is necessary for clearance of Publicity by Publicity Screening Committee for censor of the film.
    q) i) Titles of Films would not be given for Web Series/ Web Films/ TV Serials/ Telefilms/ Short Films.
    ii) Titles of Web Series/ Web Films/ TV Serials/ Telefilms/ Short Films would not be given for films.

  21. TITLES FOR DUBBED FILMS
    i)Original language titles of Hindi Films/ Similar titles would not be allotted to any Producer for Dubbed Films.
    ii) The word ‘DUBBED’ must be written in bold letters in the publicity designs of the dubbed film.
    iii) The language of the dubbed film must be written in bold letters

  22. TITLES FOR REGIONAL LANGUAGE FILMS
    i)The titles of all language films (eg. Bhojpuri/ Marathi/ Gujarati/ Punjabi and dubbed film’s language) should be prominently displayed in the publicity, otherwise publicity of the film will not be cleared.
    ii) The titles of Sanskrit language films would be treated as separate language and not clubbed with Hindi language
    iii) Titles of all language films should be written in bold letters of the same language.

  23. TITLES FOR ANIMATION FILMS
    Animation Films will be treated as a separate category. Titles allotted to animation films for different languages will be charged as per the number of languages in which animation film is made. Titles of Animation Films would not be given for Films and Titles of Films would not be given for Animation Films.

  24. TITLES OF CLASSIC FILMS
    To give respect to the filmmakers, titles of Classic/ Hit films not necessarily related to commercial success but which create an impact on the society made by legendary Directors/ Producers, will not be given for Hindi and/ or any other language. It will be the sole discretion of the Title Registration Committee to allot titles in such category.

  25. LIMITATIONS
    a) (i) No Title shall be registered, If it has already been registered with the Film Makers Combine.
    (ii) No Title shall be registered, If the period of validity of the title already registered has not expired.
    (iii) No Title shall be registered, If it has been applied for renewal.
    (iv) No Title shall be registered, If it is under dispute.

    b) (i) No Title shall be registered, If it has been used in producing a Feature Film/ TV Serial/ Tele – Film/ Video Film/ Web Film/ Series, Animation Film/ T.V New/ Documentary Film/ Short Film/ Music Album/ Event Show/ Reality Show/ Digital Platforms and/ or any other audio/ visual formats or invented in future for a period of 5 (five) years from the date of first Publicity Clearance from Film Makers Combine
    (ii) No Title shall be registered, If the Producer of such Publicity cleared picture renews the title after 5 (five) years.
    c) No Title shall be registered, If the title is found to be objectionable viz. vulgar/ in bad taste/ in abusive language/ offensive/ derogatory to the women/ our country, insulting to any community/ caste/ minority/ objectionable name or word contrary to law, morality or govt. policy.

  26. VALIDITY OF REGISTRATION OF TITLES
    a) The registration of any title shall be valid for a period of one year from the date of registration.
    b) If the allotted title for any category is not utilized within a period of one year, it will be renewed for another one year on the receipt of renewal fees.
    c) In case, the Producer is not able to start his/ her project due to pre production work in first two years, the title registered in the banner of the Producer can be renewed for the third year also against receipt of renewal fees.
    d) i) A Renewal Notice will be sent by the Association to the Producer in whose banner the title is registered at least 30 (thirty) days before the expiry date of the title.
    ii) Another 45 (forty-five) days grace period after the expiry date of title will be given to the Producer to renew the title.
    iii) In case no application for renewal of the title is received from the Producer, the title registered with Film Makers Combine will be available for fresh registration.
    e) After a period of three years, if the title is to be renewed by the Producer, the Title Registration Committee will ask the ‘Progress Report’ from the Producer by sending three reminders by Speed Post/ Email and if there is no reply, the title would be allotted to the first member in waiting list.

  27. Meaning of Progress Report
    In response to the Film Makers Combine’s enquiry about Progress Report of the titles acquired by the Producers, it is mandatory on the part of the Producers to give reply after the completion of (three) years period of retaining the title/s as per the following details:
    1.Signing of Director/ Story Writer/ Music Director/ Artists/ Technicians and Vendors of their confirmation with proof of the payment given
    2. Completion of Script
    3. Songs Recording
    4. Shooting Progress
    5. Post Production: Editing, Dubbing, Background Music, Effects
    6. Publicity Clearance by Publicity Screening Committee
    7. Censor Application
    If there is no progress of the film as per the above format and the Producer remains silent/ or shows his/ her helplessness, the assigned titles would be cancelled from their and given to other Producer in waiting.

    f) The Producer is bound to complete at least 50% of the film’s shooting and post production while giving details of progress of the film.
    g) If any title remains unused (i.e. neither shooting nor recording done) by a Producer for a period of 3 (three) years and if there is an application for the same title from another Producer, the Committee would ask for an explanation from the title holder why the said title be not given to the new applicant.
    h) If the Producer fails to give the documentary proof of the progress of the film or is unable to make satisfactory explanation, the Title Registration Committee may use its discretionary powers to allot the title in favour of the new applicant or the first applicant in waiting list.

  28. FEES
    Subject to revision from time to time by the Title Registration Committee, the fees payable by member for each title with the Affiliate shall be as under:
    For the first year of Registration: Rs.250/- plus prevailing GST
    For the second year of Registration: Rs.400/- plus prevailing GST
    For the third year of Registration: Rs.500/- plus prevailing GST
    For the fourth year of Registration or thereafter every year: Rs.1500/- plus prevailing GST
    Titles in mixed languages i.e Hinglish (English & Hindi) will be charged as two titles
    a) After the submission of Publicity Clearance of the Feature film for which the title has been registered with the Film Makers Combine, no re – registration fee of such title shall be required and the title of such feature film shall remain registered with the Film Makers Combine without any further payment of fees for a period of 5 (five) years from the date of Publicity Clearance.
    b) (i) On submission of Publicity Clearance of the film by the Producer, the title of the film will be immediately blocked and letter of confirmation of the blocking will be issued to the Producer.
    (ii) The 5 (five) years period of blocking the title of the Producer will be counted from the date of the Publicity Clearance of the film.
    (iii) If after getting publicity clearance from the Publicity Screening Committee, the Producer delays the application for censor for six months, he/ she will again be charged full fees for the clearance of publicity of his/her film and period of five years will be counted from that date.
    c) After the last date of Publicity Clearance upto a period of 5 (five) years, it would be necessary to renew the title every year by paying the required fees of Rs.500/- plus prevailing GST per year.
    d) The titles registered with Trade Mark Authorities are blocked for 10 years, now the title fees plus GST would be charged for period of blocking of titles with Trade Mark Authorities
    e) i) Members are at liberty to apply for registration of a title in all 15 (Fifteen) languages at a lump sum fees of Rs.2500/- (Rs. Two Thousand Five Hundred Only) plus prevailing GST for the first year of registration.
    ii) Renewal of title in all 15 (Fifteen) languages, at a lump sum fees of Rs. 3000/- (Rs. Three Thousand Only) plus prevailing GST fees will be applicable for 2nd year of registration.
    iii) Renewal of title in all 15 (Fifteen) languages, at a lump sum fees of Rs. 3500/- (Rs. Three Thousand Five Hundred Only) plus prevailing GST fees will be applicable for 3rd year of registration.
    iv) Renewal of title in all 15 (Fifteen) languages, at a lump sum fees of Rs. 5000/- (Rs. Five Thousand Only) plus prevailing GST fees will be applicable for 4th year of registration.
    f) i) Members are at liberty to apply for registration of a title in all Categories at a lump sum fees of Rs.2500/- (Rs. Two Thousand Five Hundred Only) plus prevailing GST for the first year of registration.
    ii) Renewal of title in all Categories at a lump sum fees of Rs. 3000/- (Rs. Three Thousand Only) plus prevailing GST fees will be applicable for 2nd year of registration.
    iii) Renewal of title in all Categories at a lump sum fees of Rs. 3500/- (Rs. Three Thousand Five Hundred Only) plus prevailing GST fees will be applicable for 3rd year of registration.
    iv) Renewal of title in all Categories at a lump sum fees of Rs. 5000/- (Rs. Five Thousand Only) plus prevailing GST fees will be applicable for 4th year of registration
    g) Film Makers Combine will protect the title/s of the Producer for five years if the Producer pays the registration fees for five years at the receipt of title certificate from Film Makers Combine for Documentary/ Short Films.
    h) Any notices required to be sent to the Producer under the rules and regulations will be sent by Film Makers Combine by hand delivery, post, courier, email or any other digital facility at the address of the Producer in our records.

  29. INDEMNITY
    a) Registration of a Title in favour of a Producer with Film Makers Combine has facilitated member Producers to save them from any similar looking title granted by other Association. The Film Makers Combine has no legal liability or responsibility upon the said registration of titles. Hon. Members shall protect Film Makers Combine. Hon. Chair Persons, Hon. General Secretaries, Office Bearers, Executive Committee Members, Title Registration Committee, Publicity Screening Committee, Disciplinary Committee, Grievances Committee, Rules and Regulations Committee and the Film Makers Combine staff and its affiliates from any legal consequences.
    b) i) CBFC has the right to reject the title of a film at any stage as per the guidelines, clause no.6 of CBFC which clearly indicates that the Board shall scrutinize the titles of the films carefully and ensure that ‘they are not provocative, vulgar, offensive or violative of any of the above-mentioned guidelines.
    ii) If the title approved by Title Registration Committee is not accepted by Central Board of Film Certification due to any reason at the time of censor, Film Makers Combine will not be responsible for the registration of such title and has no legal liability whatsoever.
    c) i) If any title registered by FMC is cancelled by CBFC or any action regarding the cancelled title is taken by CBFC/ any other Organization/ Association/ Govt. or any other statutory body, FMC will not be responsible or liable for any action and or expenses of any court case/ litigation, It shall be the responsible of concerned Producers to protect Film Makers Combine and all its Sub Committees from any litigation, cost and consequences
    ii) That Film Makers Combine, all its Sub Committees and Affiliates shall be governed by the laws of India.
    iii) That any matter not solved by Film Makers Combine shall have the jurisdiction of Mumbai Courts only.
    d) The Producers who apply for TV/ Cable News/ would give Indemnity Bond on stamp paper of Rs.500/- (Rs. Five Hundred Only) duly notarized that ‘they would get permission from Police

  30. Authorities and indemnify Film Makers Combine from any lapse on their part, any dispute/ or any complaint etc’.
    e) Member Producers Indemnify Film Makers Combine/ Hon. Office Bearers/ Staff that they will not be held responsible and liable for any dispute/ claim arisen out of the allotment of the applied title/s if the applied titles are already registered in favour of anybody else or registered under Trademark or any human error occurs while allotting titles.
    f) Member Producers absolve Film Makers Combine, its Office Bearers/ Sub Committee Members/ Staff of any legal consequences, arisen out of titles disputes and legal matters. This is irrevocable
    Last but not the least, the Rules and Regulations Committee of Film Makers Combine will have the prerogative to make amendments in rules and regulations in view of the changing times, advanced technology for the betterment of Producers and the growth of Feature Films/ TV Serials/ Tele – Films/ Video Films/ Web Films/ Series, Animation Films/ T.V. News/ Documentary Films/ Short Films/ Music Albums/ Events Shows/ Reality Shows, Digital Platforms and/ or any other audio/ visual formats or invented in future.
